Two convicted porn spammers may now face jail time under the United State's 2004 CAN-SPAM act.
In a jury trial, Jeffrey Kilbride and James Schaffer have been found guilty of eight different violations of law. According to sources, this criminal prosecution was the first to make use of the CAN-SPAM act.
Almost all indicators suggest the CAN-SPAM act has done little to reduce the influx of junk mail. Users are best advised to deploy a program to block junk mail as opposed to waiting for CAN-SPAM 2.0 to save them.
The value of the spam operation was placed at approximately 2 million dollars. They made their money by referring visitors to pornographic websites. These websites then paid them a certain amount of money for each visitor.
Apparently they sent unsolicited pornographic content to recipients which included children. In addition they sent email from domains registered with intentionally inaccurate information. Both of these are illegal under the CAN-SPAM act.
They also face money laundering charges in conjunction with their business operation. If the judge isn't feeling lenient, they may face over 20 years in prison.
