CAUCE on FTC Decision not to Create do not Spam List

Commentary by antispam group Cauce.org on the FTC's decision not to create a do not spam list.

Their stance is that such an anti-spam list may actually provide grounds for spam protection.

If consumers could sue fraudulent junk mailers the way they can sue junk faxers - they argue that many spammers could be put out of business.

However, this release seems to miss to subtleties of the spam problem. Almost all spam claims to be "opt-in." If someone "opts-in" to one service legitimately in exchange for a service on the grounds they can sell their email to other mailers - who is the federal government to say they don't have that right? The law gets unclear very quickly when it comes to spam email.

Washington and other states have similar laws to this on the books - and they haven't helped much.
