Spammer Sues User for Reporting Their Spam

Apparently the email spam sender lost their internet connectivity, and is subsequently having problems with the emails being blocked by various blacklists.

In an initial hearing by a New Hampshire Court did not result in a dismissal as hoped. I have to question the sanity of the judge. It seems fairly intuitive that this is a bogus case.

The spammer in question - "VirtualMDA" - apparently employs other users to distribute junk email for them. Paying users $1 / hour for use of their computers.

By distributing the sending of messages - it makes it much tougher for spam email filter applications to use blacklists to reliably ban messages being sent by a given spammer.

Many spammers use networks of computers that have been compromised by worms or "malware" to send spam for the same reasons. It would seem that this behavior would be illegal - but some malware has licensing agreements that could potentially survive legal scrutiny.

The defendant - Jay Stuler - is taking donations via http://spamlawsuit.spamshield.org/.

I think it's unlikely any jury or court would side with the spammer. However, the legal fees to make sure this doesn't happen could certainly add up.
