Don't Mess with (or Spam in) Texas

They are being sued both by the state of Texas and Microsoft for sending tens of millions of unwanted commercial messages to users on the internet.

The fines could run as high as $2 million.

The messages contained misleading content, specifically banned by the CAN-SPAM anti-spam legislation. The CAN-SPAM act was passed in 2003 and enacted in 2004. Most anti-spam experts say it has had little effect on the amount of junk e-mail being sent.

In addition to being in violation of CAN-SPAM, they apparently also broke various Texas state laws. Microsoft is involved due to the spam being sent over their networks. Microsoft has been using its resources to figure out how to get rid of spam for its millions of Hotmail users.

The e-mails they sent were designed to collect information on the users in a claimed effort to sell them financial services. Instead of providing the services they claimed they'd offer, they would sell the user's information to other companies for as much as $28 per person.

This kind of misleading activity is made illegal by the CAN-SPAM act.
