Anti-Spam Law in Violation of Constitution

A Maryland state e-mail spam law has been found unconstitutional by a judge in that state. The grounds were that it unduly hampers interstate financial transactions.

The judge - Durke Thompson, ruled that the legislation is biased against out-of-state business. That kind of restriction is not allowed by the United States Constitution.

The ruling was the result of a lawsuit taken against a New York business by a Maryland law student on the grounds that they were employing offensive marketing practices. A portion of the reason the lawsuit was dismissed was due to the lack of clarity of the destination of the intended recipient of the message.

Technicalities like these have made the enforcement of anti-spam laws difficult.
