CAN-SPAM Violator Settles for $25k Fine

DC Enterprises was one of the first companies prosecuted for violating the CAN-SPAM act. The Florida based company spammed thousands of people with offers for loan applications which failed to comply with the law.

While they did include the mandated physical mailing address for opting-out - the one they gave was apparently false - or at least not used. The company did not make any effort to block emails targeted at users who make requests to that address. The suit was filed in a county level superior court in Massachusetts.

Relatively few suites have been filed under CAN-SPAM thus far - and most studies show it has failed to block unwanted email. The case was settled for a fine of $25k. If the company further violates the CAN-SPAM act - the settlement is voided and they may be susceptible to further penalties.
