Earthlink Suing Spammers (Again)

Earthlink has just announced that they've filed four lawsuits against accused spammers in Nevada, California, Washington and Florida.

The charges are in accordance with CAN-SPAM, another federal law against fraud and various state-level anti-spam e-mail laws.

The spammers apparently engaged in multiple violations of the CAN-SPAM act with outlaws things fake email addresses and misleading subject lines. It also requires that senders of junk email identify their physical addresses and contact information within the message.

These regulations apply for all commercial messages, not just spam.

Earthlink has taken a tough stance spam. It makes e-mail spam filter technology available to its users free of additional charge. This is the second major round of lawsuit Earthlink has recently filed against spammers. Earlier this year they reached a settlement entitling them to a large amount of monetary compensation from a spammer.

Despite the proliferation of lawsuits filed by internet providers such as Earthlink, spam continues to increase. Legal action definitely increases the risk and costs involved with spamming. Spamming still clearly remains profitable. Only time will tell if the court system can actually help at blocking junk email.

Those who want to protect themselves from being overwhelmed by junk messages may want to consider installing a spam email blocker program. SpamButcher is available as a free spam killer download from www.spambutcher.com.

Spammers also commonly violate fraud laws not directly tied to spam. Spammers commonly pitch goods such as pirated software, fake degrees and prescription drugs of questionable origin. The accused parties in this lawsuit were apparently advertising time-share property, pornography and printer cartridges.
